Local phone companies provide us with these access numbers and we are confident that the number given to you was a local number for you to call based on the telephone number that you will be dialing in from. However, many changes are taking place in local dialing areas - new area codes, new prefixes, etc. Like with any Internet service, before using these access numbers, please call your phone company and confirm the number you are dialing is a local call. accessBee will not be held responsible for any toll charges or long distance fees you may incur when dialing-in to our service." PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES


The terms of this Subscriber Agreement comprise the terms and conditions governing all persons ("Subscribers", "You" and "Your") who have signed up for access to and use of the AccessBee Internet Services ("Services") and AccessBee web sit ("Site"). It is essential to understand and comply with each provision set forth herein.

IF YOU DO NOT AGREE WITH THE TERMS OF THIS SUBSCRIBER AGREEMENT, DO NOT USE THE ACCESSBEE SERVICE.

THE BEE, as defined in paragraph 1 below, reserves the right to amend the terms and conditions under which You will be given access to and use of the Site and the Services from time to time and without further notice. Your continued use of the Site and the Services after any such changes constitutes your acceptance the new terms. If you do not agree to abide by these or any future terms, please do not use the Site and the Services. TERMS OF SERVICE

1.The Services consists of access to the Internet, email and other services provided by the Sacramento Bee or a third party under contract with the Sacramento Bee (hereinafter "THE BEE"). The Services, which are being provided under the brand name "AccessBee," also offer You access to information, software and services that may be owned or made available by third parties.

2. Subject to the terms of this Agreement, THE BEE grants to You only a personal, non-exclusive, non-assignable and nontransferable license to use and display the content receive through the Site or the Services on any computer or other Internet access device of which You are the primary user. You may not sublicense, assign, or transfer this Agreement. Any attempt to sublicense, assign or transfer any of the rights, duties or obligations under this Agreement shall be void.

3. THE BEE may (i) terminate, change, suspend or discontinue any aspect of the Services or Site, including the availability of any features, at any time, without prior notice or liability to You or any third party and (ii) remove, modify or otherwise change any content, including that of third parties, on or from this Site, without prior notice or liability to You or any third party. THE BEE may impose limits on certain features or restrict access to parts or all of the Services or Site without notice or liability.

4. Unless otherwise agreed, Your right to use the Services is not transferable and is subject to any limits established by THE BEE, or by Your credit card company if billing is through a credit card.

5. You are responsible for all uses of the Services accessed through Your user name and password(s).

6. You are responsible for and must provide and pay for all telephone and other equipment and services necessary to access the Services.

7. You agree to pay to THE BEE any monthly or other fees incurred by You or anyone using Your user name and password at the rates in effect for the billing period in which those fees are incurred, including but not limited to charges for any purchases made through the Service and any surcharges incurred while using any supplemental networks or services other than the Services. You shall pay all applicable sales and use taxes relating to Your use of the Services.

8. The Site may from time to time contain links to other web sites or other Internet information sources ("Third Party Sources"). These links are provided as a convenience and do not constitute an endorsement, sponsorship or recommendation by THE BEE of -- or responsibility for -- the third parties or the linked Third Party Sources or any content, services or products available on or through such Third Party Sources.

9. All content available through the Site, including data, quotes, status reports, technical drawings, configurations, and catalog listings is believed to be accurate. However, You should independently evaluate the accuracy of any information contained on the Internet and the usefulness of any product or service available through this Site or the Services for your particular needs. Specifications for products and services are subject to change without notice. All information on the Site and available through the Services is subject to the disclaimers below.

WARRANTY DISCLAIMERS; LIABILITY LIMITATIONS

10. THE CONTENT AVAILABLE ON THE SITE AND THROUGH THE SERVICES IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU EXPRESSLY AGREE THAT USE OF THIS SITE AND/OR THE SERVICES AND ANY CONTENT IS AT YOUR SOLE RISK.

11. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, THE BEE AND ITS AFFILIATES DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

12. YOU EXPRESSLY AGREE THAT USE OF THIS SITE AND SERVICES, INCLUDING ALL CONTENT, DATA OR SOFTWARE DISTRIBUTED BY, DOWNLOADED OR ACCESSED FROM OR THROUGH THE SITE OR SERVICES, IS AT YOUR SOLE RISK. YOU UNDERSTAND AND AGREE THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR BUSINESS, YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH CONTENT, DATA AND/OR SOFTWARE.

13. YOU ACKNOWLEDGE THAT THE BEE DOES NOT CONTROL ANY INFORMATION, PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES THROUGH THE SITE OR SERVICES. THE BEE AND ITS AFFILIATES ASSUME NO RESPONSIBILITY FOR AND MAKE NO WARRANTY OR REPRESENTATION AS TO THE ACCURACY, CURRENCY, COMPLETENESS, RELIABILITY OR USEFULNESS OF CONTENT OR PRODUCTS DISTRIBUTED OR MADE AVAILABLE BY THIRD PARTIES THROUGH THE SITE OR THE SERVICES. REFERENCE TO ANY PRODUCTS, SERVICES, PROCESSES, OR OTHER INFORMATION, BY TRADE NAME, TRADEMARK, MANUFACTURER, SUPPLIER, OR OTHERWISE DOES NOT CONSTITUTE OR IMPLY ENDORSEMENT, SPONSORSHIP OR RECOMMENDATION THEREOF BY THE BEE.

14. THE BEE DOES NOT MAKE ANY WARRANTY THAT THIS SITE, ITS CONTENT, OR THE SERVICES WILL MEET YOUR REQUIREMENTS, OR THAT THIS SITE, ITS CONTENT, OR THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED. NOR DOES THE BEE MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE, ITS CONTENT OR THE SERVICES, OR AS TO THE ACCURACY, COMPLETENESS OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE USE OF THE SITE OR SERVICES.

15. THE BEE ASSUMES NO RESPONSIBILITY FOR ANY DAMAGES SUFFERED BY YOU OR ANY THIRD PARTY, INCLUDING BUT NOT LIMITED TO, LOSS OF DATA FROM DELAYS, NONDELIVERIES OF CONTENT OR EMAIL, ERRORS, SYSTEM DOWN TIME, MISDELIVERIES OF CONTENT OR EMAIL, NETWORK OR SYSTEM OUTAGES, FILE CORRUPTION, OR SERVICE INTERRUPTIONS CAUSED BY THE NEGLIGENCE OF THE BEE, ITS AFFILIATES, ITS LICENSORS, OR A USER'S OWN ERRORS AND/OR OMISSIONS.

16.THE BEE does not claim any ownership interest in the communications or content you receive or submit or make available while using the Service. You agree that with regard to any communications you transmit to anyone through the Service, or content you post on the Site, including, without limitation, questions, comments, suggestions, ideas, plans, notes, drawings, configurations, purchase orders, quotes, performance data, account information, or other material, data or information (collectively, "Information"), THE BEE shall have the right to copy such Information in connection with maintaining and backing up the Site and Service.

17. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE BEE OR THROUGH THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN AN APPLICABLE WRITTEN CONTRACT BETWEEN YOU AND THE BEE.

18. REFUND POLICY: If for some reason you are not completely satisfied with your accessBee Internet service within seven (7) consecutive days of use from the day you signed up, you may request a full refund by emailing support@accessbee.com or calling support at (916) 471-1271. Your refund will be granted within a thirty (30) day period in the form of a credit on the credit card used at the time of sign-up.

19. EARNING COMPLIMENTARY MONTH(S) VIA THE ACCESSBEE REFERAL PROGRAM: Should a new user sign-up with accessBee and inform the support staff AT THE TIME OF SIGN-UP that they were referred by an existing accessBee customer by full name and, one in good standing, that current customer will be granted one-complimentary month of accessBee service. The complimentary month will be granted after the new user has been active on the accessBee network for a period of eight-days.

USER CONDUCT

20. In using the Site or Services, you agree:

(a) not to disrupt or interfere with the security of, or otherwise abuse, the Site, or any Services, system resources, accounts, servers or networks connected to or accessible through the Site or affiliated or linked sites;

(b) not to disrupt or interfere with any other user's enjoyment of the Services, the Site or affiliated or linked sites;

(c) to maintain a connection only for the active use of the Internet, email and other Services, and not on a standby or inactive basis, or by pinging or otherwise sustaining the connection;

(d) not to knowingly upload, post, or otherwise transmit through the Services or on this Site any viruses or other harmful, disruptive or destructive files;

(e) not to use or attempt to use another's account, service or system without authorization from THE BEE, or to create or use a false identity on the Site or in connection with the Services;

(f) not to transmit through the Services or on the Site any spam, chain letters, junk mail or any other type of unsolicited mass email to people or entities;

(g) not to reproduce, redistribute, retransmit, publish, or otherwise transfer or commercially exploit any content contained on the Site or receive through the Services without the owner's express written consent; and

(h) not to attempt to obtain unauthorized access to the Services or portions of the Site or Services that are restricted from general access.

19. You agree that You are solely responsible for actions and communications undertaken or transmitted under your account, and that you will comply with all applicable local, state, national and international laws and regulations, including but not limited to United States export restrictions, that relate to Your use of or activities on this Site.

20. The Site and Services may contain areas where You may post and share comments with other Internet users on a variety of subjects. You agree that You will not post or otherwise disseminate on the Site or through the Services any unlawful, harassing, libelous, tortuous, abusive, offensive, threatening, or obscene communications or material of any kind, or materials which infringe or violate any third party's copyright, trademark, trade secret, privacy or other proprietary or property right, or that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation; or, that are otherwise objectionable, including without limitation, content that evidences bigotry, racism, sexism, or hatred, or that promotes illegal activities or physical harm against anyone. THE BEE reserves the right but not the obligation to remove any materials it deems objectionable. You agree to hold harmless THE BEE and its affiliates and parties with whom THE BEE has contracted for purposes of hosting or maintaining this Site from all claims based upon communications made or materials posted by others or the use by third parties of this Site.

21. You agree that any communications you transmit to anyone through the Site, or copyrighted works you post on the Site, including, without limitation, questions, comments, suggestions, ideas, plans, notes, drawings, configurations, purchase orders, quotes, performance data, account information, or other material, data or information (collectively, "Information"), are non-confidential and upon transmission of such information to the Site via email or other means you grant and agree to grant to THE BEE an irrevocable, non-exclusive, royalty-free, world wide license, including the right to sublicense others under any intellectual property rights (including but not limited to copyrights), to use, copy, modify and distribute such Information for any purpose.

22. THE BEE reserve the right to prohibit conduct, communication, or content on or in connection with Your use of the Site or the Services which THE BEE deems in their sole discretion to be harmful to any Subscriber, the communities which comprise the Site, and any third-parties' rights, or to violate applicable law. Notwithstanding the foregoing, neither THE BEE, nor any affiliate or any content provider, have the practical ability to restrict conduct, communication or content which might violate the these Terms of Use prior to transmission over the Internet, nor can they ensure prompt editing or removal of actually or potentially violating Content after online posting. Accordingly, You acknowledge that neither THE BEE, nor any affiliate or content provider shall assume or have any liability for any action or inaction with respect to conduct, communication or content on the Site or Services.

PRIVACY

23. THE BEE believes strongly in informing users about the use and privacy of their information. Therefore, THE BEE has adopted a Privacy Policy that may be viewed below. As a user of the Site, You should refer to the Privacy Policy that sets forth how THE BEE collects and uses information. This Agreement contains the full understanding of the parties with respect to the subject matter hereof, and no waiver, alteration, or modification of any of the provisions hereof shall be binding on either party unless in writing and signed by duly authorized representatives of the parties. Neither the course of conduct between parties nor trade practice shall act to modify the provisions of this Agreement.

GENERAL TERMS

24. This agreement is, and shall be governed by and construed in accordance with the law of the State of California applicable to agreements, made and performed in California. The parties agree to waive the application of the United Nations Convention on Contracts for the International Sale of Goods. You agree that any claim arising out of or related to the terms or Your use of the Site or Services must be filed within one year after it arose or be permanently barred.

25. You agree to indemnify, defend and hold THE BEE, its suppliers, parent, subsidiaries, affiliates, officers, directors, shareholders, agents, partners and employees, harmless from any claims, liabilities, demands or expenses, including reasonable attorney's fees, made by any third party due to or arising out of the use of Your Subscriber account., Your violation of this Agreement, or Your violation of any rights of another.

26. Notice to You may be made via either e-mail or regular mail. THE BEE may also provide notice of changes to this Agreement or other matters by displaying notices or links to notices to You generally on the Site.

27. The terms and conditions of this Agreement and those posted on the Site, constitute the entire agreement between THE BEE and You with respect to the Site and the Services and supersede all other communications. Should any provision in this Agreement be found invalid or unenforceable for any reason, then that provision shall be deemed severable from the terms and shall not affect the validity or enforceability of the remaining provisions. THE BEE's failure to enforce the strict performance of any provision under this Agreement shall not constitute a waiver of THE BEE's right to subsequently enforce such provision or any other provisions.

By reading these terms and conditions and chooseing to continue as a accessBee subscriber and not immediatly canceling your accessbee account you acknowledge that You (i) have read and agree to be bound by the terms of this Agreement as well as all other policies contained on the Site, and (ii) authorize the Sacramento Bee to charge Your credit card monthly for the charges related to Your account until You cancel the Services. If you do not agree with these terms, please immediatly contact us via email or phone at (916) 471-1271 to cancel your account.

What are cookies and how does AccessBee use them?

AccessBee also collects IP addresses for system administration and to report aggregate information to our advertisers.

How does AccessBee use my information?

AccessBee's primary goal in collecting personal information is to provide you, our valued subscriber, with a customized browsing experience. This includes personalization services, interactive communications, communications on products or services we think you might find of interest, online shopping and many other types of services, most of which are completely free to you. By knowing a little about you, AccessBee is able to deliver more relevant information and choices to you, and hence provide you with better service.

In our role of delivering targeted advertisements, AccessBee plays the middleman. Advertisers give us an advertisement and tell us the type of audience they want to reach (for example, males over 35 years old). AccessBee takes the advertisement and displays it to users meeting those criteria. In this process, the advertiser never has access to individual user information. Only AccessBee has access to individuals' accounts. This kind of advertisement targeting is done with banner ads.

In order to provide subscribers with low Internet access services, we display partner's advertisements and we may contact you occasionally to notify you of special offers that you may find of interest from the Sacramento Bee and from carefully selected third party marketing partners.

AccessBee develops customers' demographics, interests, and behavior based on the information provided to us upon registration, during a promotion, from our server log files or from surveys. We do this to better understand and serve our customers, and to continually improve our web site and product offerings. This information is compiled and analyzed on an aggregated basis. AccessBee may share this aggregated data with advertisers or business partners.

Who is collecting information?

When you are using AccessBee and are asked for personal information, you are sharing that information with AccessBee alone (or agents working on behalf of AccessBee and under confidentiality agreements), unless it is specifically stated otherwise. For example, some AccessBee products and services are offered in conjunction with a partner. With whom does AccessBee share my information?

As a general rule, AccessBee will not disclose any of your personally identifiable information except when we have your permission or under special circumstances, such as when we believe in good faith that the law requires it or under the circumstances described below. The following describes some of the ways that your information may be disclosed.

Business Partners and Sponsors:

AccessBee may disclose your personal information to business partners or sponsors, but this is specifically described to you prior to data collection or prior to transferring the data. Some or all data collected during an AccessBee promotion may be shared with a sponsor. If personally identifying data about you will be shared, we will tell you before we collect or transfer the data.

Many promotions offer opportunities to request additional information from sponsors. By requesting more information, you give AccessBee permission to transfer your personal information to the sponsor so it can fulfill your request. In many instances, only your email address will be shared. If more information will be shared with the sponsor, you will be notified prior to the transfer.

Third Party Data and Data in the Aggregate: Under confidentiality agreements, AccessBee may match user information with third party data. Also, AccessBee will disclose aggregated user statistics (for example, 45% of our users are female) in order to describe our services to prospective partners, advertisers, and other third parties, and for other lawful purposes.

Other: AccessBee may also disclose account information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating AccessBee's Terms of Use or may be causing injury to or interference with (either intentionally or unintentionally) AccessBee's rights or property, other AccessBee users, or anyone else that could be harmed by such activities. AccessBee may disclose or access account information when we believe in good faith that the law requires it and for administrative and other purposes that we deem necessary to maintain, service, and improve our products and services.

What are my choices regarding collection, use, and distribution of my information?

AccessBee may, from time to time, send you email regarding our products and services and those of our partners. Only AccessBee (or agents working on behalf of AccessBee and under confidentiality agreements) will send you these offerings.

On some types of AccessBee promotions, we will ask for your email address in order to update you on your score, entries, and status in prize drawings. When you participate in these types of promotions, you automatically receive promotion-related email, unless you choose the no-email option that some promotions offer. Occasionally these promotion-related email messages may include targeted advertisements.

You also have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is sent, or to reject all cookies. If you choose to reject all cookies you will be unable to use those AccessBee services that require registration in order to participate.

How does AccessBee protect my personal financial information?

Keeping your personal financial information private is vitally important to us. Knowing that you use certain services or features may help us to offer you better and more relevant content and advertisements. But as with all personally identifiable information, we do not make this available to any third parties without your permission. Any user statistics that we may provide to prospective advertisers or partners regarding financial product or service usage on AccessBee are provided in the aggregate only and do not include any personally identifiable information about any individual customer.

Please note that there are several places on AccessBee where you can transmit credit card information in order to complete a purchase transaction or for verification purposes. Any time we ask for a credit card number we transmit that credit card number in an encrypted format.

What security precautions are in place to protect the loss, misuse, or alteration of my information?

Your AccessBee Account Information is password protected so that you and only you have access to this personal information. You may edit your AccessBee Account Information by using your AccessBee ID and password.

We recommend that you do not divulge your password to anyone. AccessBee will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also remember to sign out of your AccessBee account and close your browser window when you have finished your work. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe.

AccessBee has subscribers all over the world. When you give AccessBee personal information, that information may be sent electronically to servers outside of the country where you originally entered the information, such as to the United States or other countries. In addition, that information may be used, stored and processed outside of the country where you entered that information. Whenever AccessBee handles personal information as described above, regardless of where this occurs, AccessBee takes steps to ensure that your information is treated securely and in accordance with the relevant Terms of Use and this Privacy Policy.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, AccessBee cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems.

What about children's privacy?

Naturally, the safety of children is very important to us. AccessBee does not promote these Services to children, nor does it solicit or knowingly allow children to become subscribers. However, AccessBee has no way of determining whether or not a user is an adult or a child. Children should always ask a parent for permission before sending personal information to anyone online. AccessBee does not knowingly share personal information about users under the age of 13 with third parties and we do not sell or rent personal information about any of our users, regardless of age. In addition, AccessBee will not send any direct email offers to users who indicate they are under the age of 13.

What else should I know about my privacy?

Please keep in mind that whenever you voluntarily disclose personal information online, for example on message boards, through email, or in chat areas, that information can be collected and used by others. In short, if you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return.
